TUPE refers to the Transfer of Undertakings (Protection of Employment) Regulations 2006.
These regulations apply to businesses of all sizes and protect employees’ rights when the business or service they work for transfers to a new business.
The TUPE regulations can apply when a company is sold, activities are outsourced, brought in-house, transferred or a contract for services is moved from one provider to another.
TUPE is a specialist area of law and a business must comply with these regulations. It is therefore essential that advice is sought an early stage, when the transfer is still only a proposal, before any further action is taken.
